Wasch Raines Franchise Partner Adam Wasch Earns Temporary Restraining Order and Injunction in Tennessee

Wasch Raines LLP Managing Partner Adam G. Wasch represents dozens of franchise brands and multi-unit franchise owners in franchise disputes all over the country. Recently, Mr. Wasch argued for a temporary restraining order against an infringing and terminated franchisee. Mr. Wasch served as lead trial counsel through pro hac vice admission and prevailed in the Western District of Tennessee federal court for a national fried chicken franchise brand.

“Representing both franchisees and franchisors gives me a unique perspective in handling litigation and disputes for franchisors,” says Mr. Wasch. “Because of the Covid-19 pandemic, the court held this hearing telephonically due to the emergency nature of the relief requested and we were able to prevail on our Lanham Act, breach of contract, and trade secret claims in a day-long hearing. Our team locally in Memphis is top notch, and the franchisor had a secret fried chicken recipe that we were able to protect. We were happy with the result.” After the TRO was entered, the court docket reveals that the parties entered into a Consent Injunction which confirmed that the franchisee would de-brand and de-identify the infringing restaurant in Maryland and how the parties would proceed forward.

Due to the Coronavirus, many franchise brands, including brands in the restaurant and fitness categories, are facing defaulting franchisees and a number of other issues that result in disputes. Wasch Raines franchise practice group navigates these waters for both franchisors and franchisees around the country. If you are in a franchise dispute, please contact our partner Adam G.
